
AFP-MO Celebrates Judicial Deference Bill Passage
JEFFERSON CITY, MO – Today, Americans for Prosperity-Missouri (AFP-MO) celebrated the passage of legislation (SB 221) ending judicial deference, a critical check on the administrative state that will subject state agencies’ regulations to review by the courts.
This law mirrors the 2024 U.S. Supreme Court decision on Loper Bright Enterprises v. Raimondo, which dealt a major blow to the administrative state by overturning the 40-year-old Chevron doctrine that granted federal agencies the ability to interpret the scope of their own regulatory authority.
AFP-MO State Director Gary Hollis gave the following statement:
“We’re thankful to bill sponsors Senator Nick Schroer and Representative Ben Keathley for championing this legislation to restore neutrality to our judicial system by no longer requiring courts to defer to state agencies’ interpretations of the law. This is a crucial first step in the process of reining in the administrative state in Missouri. We encourage Governor Kehoe to sign this monumental legislation.”
“Next year, we will encourage the legislature to put further limits on unelected bureaucrats’ influence by passing the REINS (Regulations from the Executive in Need of Scrutiny) Act to give elected representatives a say in regulations with significant economic impact.”
